Dealing with Unions
We represent clients in all aspects of their dealings with unions including arbitrations, unfair labor practice proceedings, union organizing campaigns, representation elections, labor arbitrations, decertification petitions, collective bargaining negotiations and all matters subject to the jurisdiction of the National Labor Relations Board.
We also work with our client’s labor counsel to act as “persuaders” in order to communicate our client’s message directly to the targeted employees.
Employment Training
We create and present training programs related to legal compliance (CA and Federal) and best practices for HR departments in dealing with workplace issues including selection and evaluation. Each of our training programs is tailored to address particular problems unique to that client.
Workplace Investigations
We conduct investigations into sensitive workplace issues like sexual harassment, embezzlement and industrial accidents. Many of these matters are referred to us by law firms.
Litigation and Union Avoidance
Design and implement workplace cultures that carefully select and empower employees in order to create environments in which employees do not feel it necessary to reach out to third parties to represent them in their dealings with their employer. Insure legal compliance in the disposition of workplace issues; implement practical strategies for handling disciplinary cases that minimize the risk of litigation.
Representation of Co-Defendants (California and Federal Courts)
We represent individual managers and supervisors in litigation matters where the law firm representing the corporate defendant has concluded that separate representation is advisable.
Hospitality and Hawaii
We have substantial experience dealing with employment issues unique to the Hospitality industry including due diligence on behalf of both buyers and sellers of hospitality properties, union matters and HR best practices. Much of our work in this area has been in the Islands where we have represented some of the most famous resorts in the World.
